The Herkimer County Board of Elections is in receipt of your communication in regards to the 2020 Herkimer County Family Court Judicial Primary. We fully understand your concerns given the extreme closeness of the race.
The Herkimer County Board of Elections is dedicated to preserving the right to vote and adhering to the policies and procedures prescribed in New York State Election Law. We have consulted with the State Board of Elections and our legal counsel and believe procedures were followed properly.
The Commissioners are confident in the accuracy of the voting systems and final outcome. A candidate may seek further options and recourse within the judicial system.

Mark Rose responded to the letter by saying, “After newly found opened ballots there remains a statistical tie. Despite this, I am not surprised that they failed to act. This is another black-eye given to the voters of Herkimer County. To quote a caller from yesterday’s 100.7 FM radio interview, ‘If this doesn’t call for a recount, what does?'”
“Last, if I were to start an accounting firm I would never hire these people to count beans,” said Rose.
